Is using AI for homework cheating?

Using AI for homework is cheating when a child turns in work they did not do and cannot explain, or when the teacher said not to use it. Asking for a hint, or practicing in a lesson app, is a different use, and the assignment’s rule still wins.
There is no single statute quoted on this page. Schools set the rule for the assignment. OpenAI’s own usage policies list academic dishonesty as disallowed on its services. That does not decide a 4th-grade worksheet by itself.
